Terms for digital Moments pages

These terms apply to ordering, payment, unlocking, and use of personalized, digitally delivered Moments pages through this platform.

1. Provider and scope

The provider is the Moments operator named in the legal notice. These terms apply to all digital Moments products, including gift, birthday, Valentine, anniversary, wedding, and baby reveal pages, unless the checkout states otherwise.

2. Subject of the contract

The contract covers the creation and digital delivery of a personalized website based on the selected product world and plan. Depending on the product, the page may include texts, names, dates, locations, gift or reveal content, images, galleries, story sections, quiz questions, access passwords, admin passwords, RSVP features, or voting features.

3. Order and contract conclusion

Before checkout, a Moments page is prepared but remains inactive. By submitting the order with payment obligation and accepting the terms, privacy notice, and digital delivery notice, you make a binding offer. The contract is concluded once payment is successfully confirmed or we manually approve the order.

4. Prices, taxes, and payment

The total amount shown in checkout applies. For Germany, bank transfer and, where available, PayPal may be offered; international orders are processed through Stripe Managed Payments. For Stripe orders, Stripe may act as merchant of record and provide receipts or invoices. For bank transfer, unlocking only happens after confirmed receipt of payment.

5. Customer account, orders, and invoices

Orders may be linked to a customer account when you are logged in or use the same email address. In the account area, orders can be viewed, account data can be exported, and account data can be deleted. Invoices or tax-relevant records may remain stored after account deletion where statutory retention duties apply.

6. Digital delivery and availability period

The service is provided digitally only. After successful payment confirmation, the page is activated and made available through a personal link; access data or reset links may be sent by email. Paid pages generally remain available for 6 months, or 18 months for Wedding Plus. After that, the active page and image folder may be archived or deleted.

7. Responsibility for content and rights

You are responsible for all content, names, messages, RSVP data, quiz content, votes, and uploaded images you provide. You may only use content for which you have the necessary rights and that does not infringe third-party rights, personality rights, copyrights, trademarks, or applicable law.

8. Access protection and sharing

The page is protected by the personal link and, where configured, by an access password. Anyone who receives the link, access code, admin code, or reveal PIN may be able to use the corresponding functions. You are responsible for sharing these access details only with intended recipients.

9. Withdrawal for digital services

By consenting to immediate digital delivery, you request that we begin performance after successful payment before any withdrawal period may have expired. Where legally permitted, your right of withdrawal may expire once the digital service has been fully provided.

10. Liability and final provisions

We are fully liable for intent, gross negligence, injury to life, body, or health, and where mandatory law applies. For slight negligence, we are liable only for breaches of essential contractual obligations and limited to foreseeable damage typical for the contract. German law applies; mandatory consumer protection rights remain unaffected.
